File Use Contract

1. Ownership of Materials. These sample documents are for a single user's personal use. You cannot copy or send any of these files to others without express permission from StableWise or BAEN.

2. Limitation of Liability and Indemnity. You agree and acknowledge that you are fully responsible for your own acts while on StableWise or BAEN, and that if you are injured by any information or services on StableWise or BAEN it was your choice alone to rely on that information or service, and that if you are injured by other visitors to StableWise or BAEN, we are not to blame for those injuries.

Accordingly:

(a) You agree not to hold StableWise or BAEN responsible for any injuries or losses you may suffer from any use of StableWise or BAEN.

(b) If anyone claims that you did (or failed to do) anything on StableWise or BAEN that injured them, or violates any laws, you agree to protect StableWise and BAEN from any resulting problems. This protection includes defending StableWise and BAEN in any legal actions, making all necessary payments to others, and reimbursing StableWise and BAEN for all losses, costs and attorneys fees.

3. Law and Courts. StableWise and BAEN can be reached on the Internet from all fifty states and around the world, with many more laws and rules than StableWise or BAEN could ever keep up with. You agree that the law of StableWise' own state, Washington (but not its choice of law rules), and that the law of BAEN' own state, California (but not its choice of law rules) will apply to all matters relating to this contract and StableWise or BAEN. You also agree and consent that the above specified courts will have exclusive jurisdiction and venue for any legal actions between you and StableWise or BAEN.

4. Term. This contract begins the moment you visit StableWise or BAEN and continues until you or StableWise or BAEN terminate it. If StableWise or BAEN terminate, it will take effect immediately. If you terminate, it will take effect when StableWise and BAEN receive your notice of termination. The provisions of Item 2 above will remain in effect after any termination of this contract.

5. General. This contract is the entire understanding between you and StableWise and BAEN regarding your relationship to StableWise and BAEN. If either you or StableWise or BAEN fail to notify the other of any violations of this contract, this will not mean that you or StableWise or BAEN cannot notify the other of future violations of any part of this contract.
